New Jersey Drug Laws in Full Expansion – Medical Marijuana, Social Equity, And Worker’s Compensation

New Jersey continues to set an example for the East Coast marijuana industry with recent reforms to its drug laws, demonstrating the state’s unwavering dedication to enhancing the cannabis landscape in the United States. These progressive changes encompass various aspects, including the intersection of worker’s compensation and medical marijuana treatment, as well as the establishment of equitable regulations within the cannabis market.

Worker’s Compensation and the Shift in Drug Laws

Challenging the Status Quo

Despite the legalization of Medical Marijuana in 2010, the federal classification of marijuana as a Schedule I Drug continued to cast a shadow over its use. A significant legal milestone emerged when Vincent Hager, an employee at M&K Construction, faced a denial of worker’s compensation for his medical marijuana treatment due to federal regulations.

Consequently, when Vincent Hager, an M&K Construction employee, endured significant job-related injuries leading to a chronic pain diagnosis, he was unfairly denied worker’s compensation for his marijuana treatment due to its Schedule I classification.

The case of Hager v. M&K Construction, 462 N.J. Super. 146 (App. Div.), reached its conclusion on April 13th, 2021, in favor of Hager’s claim for reimbursement. M&K Construction’s initial stance was rooted in the federal Controlled Substances Act (CSA), which categorized marijuana as an illicit substance. They argued that reimbursement was not obligatory for a substance that could be deemed “criminally legible.”

A Turning Point for Medical Marijuana

The court, however, rejected this argument, emphasizing the “reasonable and necessary” utilization of medical marijuana in Hager’s case. This pivotal decision underscored the evolving perception of medical marijuana as a legitimate and essential form of treatment, particularly in scenarios where conventional remedies fell short.

To solidify this legal precedent, legislators introduced bill A1708, which advocates for the inclusion of medical marijuana within worker’s compensation and personal injury protection insurance. This move reflects the progressive stance of New Jersey in embracing marijuana’s therapeutic potential through state legalization.

Equity and Progress in New Jersey’s Cannabis Market

Addressing Historical Inequity

The introduction of medical cannabis in New Jersey revealed stark racial inequality disparities, prompting a renewed commitment to equity as the state progressed toward adult-use legalization. Guided by the NJ Cannabis Commission and supported by the NJCBA, efforts are underway to ensure that social equality remains a central pillar in the creation of New Jersey’s expansive marijuana market.

In addition to expanding dispensary locations, the commission will wield the authority to issue growth and distribution licenses, as well as allocate state resources to areas disproportionately affected by the historical marijuana prohibition. The ACLU New Jersey has proposed a novel solution to counter social inequities, suggesting the implementation of a special social equity license status that prioritizes individuals with prior arrests or victimization.

A Path Forward

Despite the progress, uncertainties linger regarding the timeline for approving license applications, which have been pending since 2019. While Jeff Brown, the commission’s executive director, has not provided a concrete timeline, the recent court ruling in February signals a potential resurgence in license reviews. As a result, the upcoming months hold promise for aspiring cannabis entrepreneurs in New Jersey, heralding a brighter future for the state’s cannabis industry.Gratefully, following February’s court ruling allowing license reviews, upcoming months hold promise for aspiring cannabis entrepreneurs in New Jersey.
